This Terms of Use Agreement is made by and between BillingPay and you i.e. Customer (hereinafter referred to as “the Customer/You/Your/Yours”). This Agreement contains the terms and conditions that govern Your use of this Website.
By accessing or attempting to interact with any part of this website or any of the services (collectively known as “services”) provided by BillingPay on its platform (including internet website and all its subdomains), You agree that You have read, understood and agree to be bound by this agreement.
For the purposes of this Terms of Use, the term “BillingPay” shall mean and include the BillingPay internet as well as all its subdomains. For the purposes of this Terms of Use, the term “Services” shall mean and include credit card balance transfer facilities and otherwise that the BillingPay platform makes available for You.
If You do not agree to be bound by this agreement, You shall not be allowed to access or use any part of this website. You have the right to raise your grievance for deactivation of Your account on BillingPay or choose not to sign up on BillingPay only at the initial stage of interacting with BillingPay, if You are not in agreement with any of the terms and conditions laid hereunder. The subject headings used in this Agreement are included for purposes of convenience only, and shall not affect the construction or interpretation of any provisions of this document. In addition, for purposes of construing or interpreting this Agreement:
1.1. BillingPay provides the Customer with services which allow the Customer to make credit card bill payments through its platform. The Customer authorises BillingPay to process such payments on its behalf, subject to applicable fees and terms.
1.2. The Customer agrees to provide accurate and complete information required for the provision of services.
2.1. You shall not use the services for any unlawful purpose.
2.2. You shall ensure the security and confidentiality of your account credentials and notify BillingPay immediately of any unauthorised access.
3.1. All fees payable for the services shall be as per the pricing displayed on the website or as agreed in writing.
3.2. Payments once made are non-refundable except as required by law.
4.1. We store your credit card data to clear off your bills.
4.2. All the PII data collected is stored securely and is shared only with underwriting NBFCs/Banks with your consent.

5.1. To the maximum extent permitted by applicable law, BillingPay shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the services.
6.1. This Agreement shall be governed by and construed in accordance with the laws of India.
6.2. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

BillingPay’s refund policy applies exclusively in cases where a transaction has been partially completed or has failed.
Refunds will be processed in accordance with the applicable terms and conditions governing such transactions.
9.1. The Customer understands and agrees that any passwords used for accessing BillingPay services are for individual use only. You acknowledge and agree that you are solely responsible for maintaining the confidentiality and security of your password. BillingPay reserves the right to monitor password usage and, at its sole discretion, require you to change your password. Should BillingPay determine that your password is insecure, you may be required to update it accordingly.
9.2. You are expressly prohibited from using any services or facilities provided by BillingPay to compromise security or tamper with system resources and/or accounts. In the event of any violation of system security, BillingPay reserves the right to disclose your details to system administrators at other sites as necessary to assist in resolving security incidents. BillingPay also reserves the right to investigate any suspected breaches of these Terms of Use.
9.3. BillingPay will cooperate fully with law enforcement authorities or court orders requesting or directing the disclosure of the identity of any individual posting e-mail messages or publishing any materials believed to violate these Terms of Use.
9.4. By accepting this agreement, you waive and hold harmless BillingPay from any claims, liabilities, or damages arising from actions taken by BillingPay during or as a result of investigations conducted by BillingPay or law enforcement authorities related to suspected violations of these Terms of Use.
